When escrow changes your CGT tax date
A transfer to an escrow address triggers CGT only if it is a disposal. This means you have truly given up beneficial ownership of the cryptoasset.
The real issue is not the wallet transfer. It is who owned the economic value at that moment.
Test who owns the economic benefit
Ask who gains if Bitcoin rises from £50,000 to £55,000 while locked. Also ask who loses if its price falls.
If the seller is already unconditionally entitled to the Bitcoin, the facts can point to a disposal at deposit. This is stronger if the seller bears any price fall.
If the buyer can recover the same Bitcoin when conditions fail, the buyer may still hold the economic benefit.
Read the release conditions first
A condition precedent is an event that must happen before someone gains an unconditional right. Think of it as a locked gate that needs a specific key.
Examples include a goods inspection, a signed property document, identity checks, or an independent dispute decision. If these conditions remain live, a deposit may be custody rather than a completed transfer.
The most frequent mistake is treating every on-chain transfer as a completed sale.
A practical tax test: Record five separate moments: deposit, locked period, release, refund and forfeiture. For each moment, note who had the right to the Bitcoin. Note who could force release, who bore price movement, and what the contract said would happen next.
Locked bitcoin: control and price risk matter
Bitcoin held in escrow does not create a new taxable event whenever its GBP price changes.
Price movement alone does not create CGT. A change in ownership may do so.
Custodial, non-custodial and smart contracts
A custodial escrow means a third party controls the wallet or keys. That party holds the crypto under the agreed terms.
A non-custodial escrow often uses multi-signature approval. This means two or more approvals are needed before funds move.
A smart contract escrow locks assets in code until a defined event occurs. Code can control release, but it does not settle the tax answer alone.

A refund is not always a repurchase
A returned escrow balance is usually not a taxable repurchase when beneficial ownership never left the buyer. It is more like getting your coat back from a cloakroom.
The coat was held for you. It was not sold and bought again.
Forfeiture needs more than a wallet record
Forfeited Bitcoin may produce a capital loss, but a loss is not automatic. You cannot claim merely because coins cannot be recovered.
The Taxation of Chargeable Gains Act 1992 has rules on disposals and allowable losses. The reason for the loss and any compensation both matter.
Whether the arrangement was commercial also matters. Keep evidence beyond the wallet record.

Where escrow creates a disposal, calculate the gain in pounds sterling at the correct tax point.
A worked escrow calculation
Assume Maya bought 0.50 BTC for £12,000, including earlier buying costs. On 8 January, she deposits it into escrow for a Bristol equipment purchase.
The agreement gives her a full refund right until delivery. On 22 January, acceptance is signed and 0.50 BTC is released.
Its GBP market value is £18,400. She pays a £36 network fee and a £120 escrow fee.
Both fees link directly to the disposal.
If release is the disposal date, proceeds are £18,400 less £156 allowable transaction costs. Her gain is £6,244.

If the seller became unconditionally entitled on 8 January, value the disposal on that earlier date.
Fees and valuations need a paper trail
Network fees and escrow fees can be allowable when they link wholly and exclusively to buying or selling the asset. Keep the invoice, platform statement and blockchain evidence.
Personal advice costs, finance charges and a general subscription need separate consideration. They may not qualify as disposal costs.
Record the exact value source and time used.
Where release is the first point that passes beneficial ownership, use its GBP market value and timestamp. A refund usually creates no new purchase if ownership never left you. If deposit passed an unconditional right earlier, that earlier deposit date can be the disposal date. Keep contract clauses, hashes and costs together, because they support the chosen date.

A defensible escrow tax position needs records that link contract rights, blockchain movements and GBP calculations.
Build one escrow evidence pack
Keep these items together for each significant arrangement:
- The signed escrow agreement, amendments and the clause setting release or refund conditions.
- Wallet addresses, transaction hashes, block timestamps and confirmation records.
- Escrow-agent emails, joint-signature requests, delivery evidence and dispute notices.
- GBP valuations at deposit, release, refund and any earlier date where entitlement may have passed.
- Network fees, escrow charges, exchange statements and the Section 104 pool calculation.

Write a short tax position note
Write four or five plain-English lines while events are fresh. State the chosen tax date and the clause that supports it.
State who bore price risk and name the valuation source. Also explain how costs entered the calculation.
This can save hours if a dispute appears months later.
